The Supreme Court finally revoked an integrated pollution prevention and control (IPPC) permit and gave Saerimner three months to cease operations at its pig farm in the village of Jusevičiai.
The ruling is not subject to appeal.
"Agreeing with the lower courts' assessment, the panel of the Lithuanian Supreme Court's judges holds that it follows from the circumstances that there were systematic violations of environmental legal norms and that the economic activity performed did not comply with the legislative requirements on air pollution and that the operator did not eliminate the violations within the established period of time," the Supreme Court said in its ruling.
The judges agreed that the Constitution protected the rights of the local community, which took Saerimner to court, to health protection and a healthy environment.
