Supreme Court acquits ex-executives of Lithuanian refinery of negligence charges

The Lithuanian Supreme Court acquitted former top executives of Mažeikių Nafta, now Orlen Lietuva, of negligence charges. Paul Nelson English, former CEO of Mažeikių Nafta, and Barton Lee Luck, his deputy, were suspected of negligence that could have led to a major fire at the refinery back in October 2006.

The court turned down an appeal in cassation lodged by the Mažeikiai District Prosecutor’s Office. The prosecutors suspected former executives of the oil refinery of neglect of duty.

The Supreme Court’s decision is final and not subject to appeal.

Prosecutors said that the former executives of Mažeikių Nafta could have caused 355-million-litas (EUR 103m) damage to the crude refinery, which was then controlled by the now-bankrupt Russian oil group Yukos.

As part of their investigation into the causes of fire, prosecutors in 2007 brought suspicions of failure to perform duties against English and Lee Luck, both US nationals. It was established that certain maintenance work had not been carried out in time.

English resigned as CEO of Mažeikių Nafta early in July 2007. Luck worked as deputy CEO until 21 January 2008, when his employment contract expired.
